Terms & Conditions
1. Project Estimates & Scope
Quotes & Validity: All estimates are valid for 30 days from issuance.
Scope Changes: Any work requested outside the agreed brief or project outline will be treated as a scope change and quoted separately or billed at a standard hourly rate of £60/hour.
2. Deliverables & Proofing
Review Rounds: Estimates include up to [e.g., 2] rounds of minor revisions within the agreed brief. Additional design iterations or structural changes after sign-off will incur extra fees.
Client Sign-off: Written approval (via email) is required at key milestones (e.g., styleframes, storyboard, animatic, final render). Approval of a stage locks that phase; reverting prior stages is subject to additional billing.
3. Intellectual Property & File Ownership
Transfer of Ownership: Upon receipt of full payment, full usage rights for the final rendered video deliverables ([e.g., MP4, MOV, ProRes]) transfer to the Client for the agreed scope/medium.
Working Files: Project files, assets, 3D models, Cinema 4D/After Effects project files, and raw renders remain the sole property of Super9 Media Ltd unless explicitly purchased under a separate Working Files License agreement.
Portfolio Self-Promotion: Super9 Media Ltd retains the right to display the final work and behind-the-scenes material in digital portfolios, showreels, and social media, unless bound by a prior Non-Disclosure Agreement (NDA).
AI Training & Scraping Restriction: Strictly no rights are granted to use, process, scrape, ingest, or extract any portion of the deliverables (including rendered images and videos), project files, 3D assets, concepts, or promotional content produced by Super9 Media Ltd. This prohibition explicitly extends to all materials published across Super9 Media Ltd's social media channels, portfolio platforms, and commercial products (including digital assets and tools sold or distributed via platforms such as Gumroad) for the purpose of training, fine-tuning, developing, or improving artificial intelligence algorithms, generative models, machine learning systems, or automated processing tools.
4. Payment Terms & Late Fees
Payment Schedule: Projects require a 50% deposit prior to project commencement, with the remaining balance due upon delivery of final preview renders and prior to unwatermarked master file release.
Payment Window: Invoices are due within 30 days of the invoice date.
Late Payment Interest: Late payments are subject to interest and recovery costs under the UK Late Payment of Commercial Debts (Interest) Act 1998 at a rate of 8% above the Bank of England base rate.
5. Cancellations & Kill Fees
Cancellation by Client: If a project is cancelled or postponed after work has commenced, the Client is liable for payment of all work completed up to the date of cancellation, or a minimum kill fee equal to the initial deposit, whichever is higher.
Day Rate Cancellations: For bookings agreed on a daily or hourly rate, if a booking or scheduled work day is cancelled or postponed with less than 24 hours' notice prior to the agreed start time, 100% of the daily rate for the first scheduled day will remain fully billable.
6. Limitation of Liability
Third-Party Assets: The Client is responsible for securing rights, licences, and clearances for any assets supplied (e.g., logos, brand fonts, audio tracks, stock footage).
Maximum Liability: Super9 Media Ltd shall not be liable for indirect or consequential losses resulting from project delays, technical issues, or distribution platforms. Liability is strictly capped at the total value of the project fee.
